New To Education Student & Client Terms and Conditions

1. Introduction and Acceptance

These Student & Client Terms and Conditions ("Terms") are a legally binding agreement between you and New To Education, LLC, a Georgia limited liability company registered in Lawrenceville, Georgia ("New To Education," "NTE," "Company," "we," "our," or "us").

These Terms govern NewToEducation.com, Newtoed.com, future NTE websites, the NTE mobile application, Community Social Page, community service pages, blogs, newsletters, tutoring, webinars, workshops, live and recorded courses, ebooks, digital products, directories, job postings, applications, donations, supporter features, AI-powered services, face-to-face services, marketplaces, messaging, and related offerings (collectively, the "Platform").

By accessing the Platform, creating an account, clicking acceptance, purchasing or booking, submitting content, selling through the Platform, communicating with another User, or otherwise using the Platform, you agree to these Terms, the NTE Privacy Policy, Community Guidelines, and applicable transaction-specific terms. If you do not agree, do not use the Platform.

If you use the Platform for an organization or business, you represent that you are authorized to bind it, and "you" includes that entity.

2. Eligibility and Minors

You must be at least eighteen (18) years old and legally capable of contracting, or use the Platform with a parent or legal guardian's authorization and supervision. Children under thirteen (13) may not independently create an account or submit personal information unless NTE provides an age-appropriate experience and obtains consent required by law.

A parent or guardian authorizing a minor accepts these Terms on the minor's behalf and is responsible for the minor's account, conduct, communications, purchases, bookings, content, and participation. Parents and guardians must assess whether each service, Provider, activity, location, and item of content is suitable and remain responsible for supervision and transportation unless NTE expressly agrees otherwise in writing.

NTE may request proof of age, identity, authority, residency, or parental consent and may restrict an account where reasonably necessary for safety or compliance.

3. Nature of the Platform

NTE operates a technology, education, content, community, directory, booking, and marketplace platform. Services may include online or face-to-face tutoring, homeschool support, exam preparation, language instruction, consulting, mentorship, webinars, courses, ebooks, digital products, resume and career services, business services, community discussions, directories, jobs, donations, rewards, saved content, recommendations, and AI assistance.

Some offerings are provided by NTE. Others are provided by independent tutors, educators, creators, sellers, vendors, businesses, organizations, advertisers, or Users ("Providers"). Unless expressly stated, NTE is not a law firm, healthcare provider, financial adviser, employment agency, school, college, accrediting body, licensing authority, or government agency. Platform use does not create an attorney-client, medical, therapeutic, fiduciary, employment, or similar relationship with NTE.

4. Independent Providers

Providers generally are not NTE employees, agents, partners, joint venturers, or legal representatives. NTE may review applications, credentials, identity information, profiles, or listings, but review is not a guarantee, certification, endorsement, or warranty of a Provider's qualifications, licensing, safety, availability, conduct, methods, opinions, or suitability.

Users should independently verify qualifications or licenses important to a service. NTE may restrict a Provider or listing but is not required to independently investigate every representation, complaint, or interaction.

5. Accounts and Security

You must provide accurate, current, and complete information. You may not impersonate another person, use information without authorization, create deceptive accounts, evade suspension, or misrepresent qualifications or affiliations.

You are responsible for safeguarding credentials and activity through your account. Notify NTE promptly of suspected unauthorized access. Accounts may not be sold, rented, transferred, or shared except through functionality approved by NTE.

6. Privacy

The NTE Privacy Policy explains how personal information is handled and is incorporated by reference. Information reasonably necessary to facilitate a booking, transaction, service, or interaction may be shared with the relevant Provider or User.

Do not post or send financial credentials, government identification numbers, protected student or health records, confidential information, or another person's private information unless required by an authorized feature and lawfully provided.

7. Community Social Page and Interactive Features

Users may be able to create profiles, follow topics or Users, publish posts, comment, react, message, review, upload media, list services, make inquiries, and report content. You are responsible for your content and interactions.

You may not harass, threaten, stalk, exploit, groom, deceive, discriminate against, sexually target, or endanger another person; distribute spam or malware; promote unlawful conduct; impersonate others; disclose private information; manipulate reviews; or circumvent safeguards.

Messages should not be treated as absolutely confidential. NTE may use automated systems and human review where reasonably necessary to operate features, investigate reports, enforce rules, protect Users, prevent fraud, or comply with law.

NTE does not endorse User content and is not responsible for Users' opinions, advice, claims, offers, or conduct. Exercise caution before moving communications off Platform or meeting in person.

8. Community Service Pages and Listings

Community service listings are offers or advertisements from independent Providers, not NTE guarantees. Providers must ensure descriptions, credentials, prices, availability, locations, images, and claims are accurate and lawful.

Before purchasing, review the Provider, scope, price, delivery, cancellation, and refund terms. Provider terms apply only where they do not conflict with these Terms, mandatory NTE policies, or law. NTE may reject, edit, limit, suspend, or remove inaccurate, unsafe, unlawful, misleading, infringing, inappropriate, or inactive listings.

9. Purchases, Bookings, and Prices

Purchases, bookings, registrations, and subscriptions are subject to availability and acceptance. Prices and material fees will be disclosed before purchase. Disclosed taxes, currency conversion, processing, travel, venue, delivery, or app-store charges may apply.

NTE may change prices prospectively but will not retroactively change a completed purchase. Promotions, credits, and rewards may have separate disclosed restrictions and expiration dates. You authorize NTE and its processors to charge your selected method for authorized purchases.

10. Marketplace Sales and 60/40 Allocation

Eligible Users may sell or license approved ebooks, courses, educational materials, digital products, live instruction, bookings, professional services, or other offerings. Such a User is a "Seller" even if also a student or client.

Unless a separate written agreement or clearly displayed program term states otherwise, the Seller receives 60% of the applicable completed sale amount and NTE retains 40%.

The "applicable completed sale amount" is the amount eligible for allocation after successful payment and completion, subject to disclosed adjustments. Refunds, reversals, chargebacks, fraudulent transactions, taxes collected for remittance, payment-processing charges, app-store commissions, currency-conversion costs, legally required withholding, Seller-funded discounts, and other disclosed transaction costs may be deducted or allocated as stated at listing, checkout, or payout.

NTE's 40% portion compensates NTE for Platform access and operation, hosting, transaction administration, customer support, marketing opportunities, technology, moderation, and related services. The allocation does not create employment, agency, partnership, or joint ownership.

Payouts may require identity and tax verification and may be subject to processing periods, minimum thresholds, reserves, refund windows, fraud review, and provider availability. NTE may reasonably delay or withhold amounts for disputes, refunds, chargebacks, suspected fraud, violations, negative balances, legal requirements, or processor restrictions. Undisputed eligible amounts will be released under the applicable payout schedule.

Sellers are responsible for their offerings' legality, accuracy, quality, delivery, intellectual-property rights, licenses, taxes, and support. Seller-specific terms may supplement this section but cannot reduce nonwaivable consumer rights.

11. Subscriptions and Automatic Renewal

Before enrollment, NTE will disclose a subscription's price, billing frequency, renewal terms, material benefits, and cancellation method. By subscribing, you authorize recurring charges until cancellation.

Cancel through the Platform or the provider through which you purchased. Apple, Google, or other marketplace subscriptions generally must be managed through that marketplace. Cancellation ordinarily stops future renewals and does not automatically refund the current period unless required by law or the displayed policy. NTE will provide notice of material recurring-price changes where required.

12. Cancellations, Refunds, and No-Shows

The policy displayed for a product, Provider, booking, event, or subscription governs that transaction. If none is displayed, NTE will assess a timely request based on service delivery, cancellation reason, work completed, digital access or download, Provider obligations, and law.

Fully delivered services, consumed sessions, substantially accessed or downloaded digital content, missed sessions, and late cancellations may be nonrefundable when disclosed, except where law requires otherwise or an offering was materially defective or not as described.

Approved refunds may return to the original method or, where lawful and agreed, Platform credit. NTE may deny fraudulent, duplicative, abusive, or bad-faith requests but does not limit mandatory consumer rights.

13. Chargebacks

Contact NTE promptly about billing concerns. Nothing eliminates lawful dispute rights, but Users may not knowingly submit false information, mischaracterize authorized charges, or seek a refund and chargeback for the same amount. NTE may submit transaction evidence, restrict access tied to reversed payments, and recover valid negative balances.

14. Digital Products, Ebooks, and Recorded Courses

Unless stated otherwise, a digital purchase grants a limited, nonexclusive, nontransferable license for personal or internal educational use; it does not transfer copyright. Users may not resell, redistribute, publicly display, share access to, upload elsewhere, remove rights notices from, or make unauthorized derivatives of digital content. Accessibility tools and legally protected uses remain permitted.

Special refund limits may apply after immediate access or download, subject to law and terms shown before purchase.

15. Tutoring and Educational Services

Outcomes depend on attendance, effort, prior knowledge, learning needs, home and school conditions, technology, health, and other factors. NTE and Providers do not guarantee grades, scores, admission, certification, scholarships, advancement, proficiency, or other results.

Platform services do not replace a school, licensed evaluation, individualized education program team, accrediting authority, or qualified professional where required. Users remain responsible for academic submissions and school rules. The Platform may not be used to cheat, impersonate a student, complete prohibited assessments, or facilitate academic misconduct.

16. AI Services

AI and automated outputs may be inaccurate, incomplete, biased, outdated, or inappropriate. Verify important information and exercise human judgment. AI output is not legal, medical, financial, mental-health, immigration, tax, employment, or other professional advice and must not be used for emergencies or decisions requiring a licensed professional.

Users may not use AI features to violate law, facilitate cheating, infringe rights, create harmful content, impersonate others, or make unlawful high-impact decisions. Additional notices presented within an AI feature also apply.

17. Blogs, Newsletters, and Editorial Content

NTE blogs, articles, newsletters, summaries, and commentary are educational and informational. They may cover allegations, charges, lawsuits, administrative actions, employment disputes, legislation, rulings, public records, and developing events. An allegation or filing is not proof, and NTE does not claim disputed facts are established unless a reliable adjudicative source establishes them.

Editorial content is not legal, medical, financial, investment, employment, or other professional advice. Laws and facts change. NTE may correct, clarify, update, archive, or remove content. External links are for convenience and do not constitute endorsement. Correction requests may be submitted below.

18. Reviews and Feedback

Reviews must reflect genuine experiences and may not be fabricated, purchased, coerced, retaliatory, manipulated, or exchanged for an undisclosed benefit. NTE may label, limit, or remove noncompliant reviews.

NTE may use voluntarily submitted suggestions or feedback without compensation, but this does not transfer ownership of personal information or separately protected content contained in the feedback.

19. Jobs and Career Services

Third parties may supply job postings, applications, or employer profiles. Unless expressly stated, NTE is not the employer, recruiter, staffing agency, or decision-maker and does not guarantee posting accuracy, interviews, offers, compensation, background-check results, immigration status, or employment.

Resume writing, cover letters, profile optimization, interview preparation, coaching, and related services do not guarantee employment, promotion, compensation, licenses, admission, or advancement. Users are responsible for truthful application materials and career decisions.

20. Health, Fitness, Martial Arts, and Physical Activity

Health, wellness, nutrition, fitness, sports, and martial-arts content is for general educational and wellness purposes, not diagnosis, treatment, medical care, rehabilitation, physical therapy, or mental-health counseling.

Physical activity may involve falls, collisions, strains, fractures, illness, disability, paralysis, or death. Users should assess their health, consult a qualified professional where appropriate, follow safety instructions, use required protective equipment, and stop when concerning symptoms occur.

To the extent permitted by law, participants assume ordinary and inherent risks of chosen activities. Nothing waives liability that cannot legally be waived.

21. Face-to-Face Services

In-person interactions are voluntary and involve risks involving travel, locations, illness, harassment, theft, assault, property, weather, and emergencies. Unless expressly agreed, NTE does not provide transportation, childcare, guardianship, medical supervision, security, or continuous monitoring.

Users must follow safety and venue rules. Initial meetings should occur in appropriate public or professional locations, not private residences, hotel rooms, secluded areas, or places identified as unsafe. Minors must be properly supervised. NTE may cancel or restrict arrangements reasonably appearing unsafe, unlawful, or misleading. Contact local emergency services in an emergency.

22. Webinars and Events

Presenters are responsible for their statements and materials, and their views do not necessarily represent NTE. Participation does not create a professional-client relationship unless expressly agreed in writing.

NTE or a host may record only after appropriate notice or consent where required. Users may not independently record or redistribute events without authorization. Schedule, presenter, format, or content changes will be addressed under the applicable event policy.

23. Donations and Supporter Features

Unless expressly stated, donations and supporter payments are voluntary support for the Platform, not investments, ownership interests, or represented tax-deductible charitable contributions. Consult a tax professional about deductibility.

Donations are generally nonrefundable except where required by law or for unauthorized payment or material processing error. If NTE facilitates support for a named third party, additional terms will identify the recipient and material administrative arrangements.

24. Affiliate, Referral, and Rewards Programs

These programs may have additional eligibility, attribution, payment, expiration, tax, and conduct rules. Participation does not create employment, agency, partnership, franchise, or guaranteed income.

NTE may prospectively modify or discontinue a program, but earned undisputed amounts will be handled under the terms applicable when earned. Deceptive advertising, spam, fake accounts, self-referrals, cookie stuffing, trademark misuse, and undisclosed sponsored endorsements are prohibited.

Points, credits, boosts, badges, and promotional benefits have no cash value unless stated, may expire as disclosed, and may be revoked for fraud or abuse.

25. User-Generated Content License

You retain ownership of content you create. You grant NTE a worldwide, nonexclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, format, technically or accessibly adapt, display, distribute, promote, and use the content as reasonably necessary to operate, improve, secure, and promote the Platform and that content.

The license lasts while content is available and for a reasonable period for backups, legal records, previously authorized promotions, and technical operations. Public content may remain in shares, quotations, indexes, or third-party copies. NTE does not claim ownership merely because content is uploaded.

You represent that you possess the rights and permissions needed to submit the content and that it does not violate law or another person's privacy, publicity, confidentiality, contract, intellectual property, or other rights.

26. Prohibited Conduct

Users may not:

  • Violate law, sanctions, court orders, or another person's rights;

  • Exploit, groom, sexualize, solicit, or endanger a minor;

  • Post threats, harassment, hate, unlawful discrimination, graphic sexual material, or serious wrongdoing instructions;

  • Sell illegal, unsafe, counterfeit, stolen, fraudulent, or unauthorized offerings;

  • Misrepresent credentials, affiliations, results, prices, reviews, or availability;

  • Infringe intellectual property, privacy, publicity, confidentiality, or contracts;

  • Upload malware, disrupt security, scrape without permission, reverse engineer protected systems, or evade controls;

  • Spam, manipulate engagement, harvest personal information, or create deceptive accounts;

  • Move a Platform-initiated transaction off Platform to evade disclosed fees;

  • Commit cheating, impersonation, fraud, money laundering, trafficking, or other unlawful activity; or

  • Retaliate against a good-faith reporter.

NTE may cooperate with lawful investigations and report apparent threats, exploitation, fraud, or crime.

27. Intellectual Property and Copyright Notices

NTE software, branding, logos, designs, original text, graphics, videos, databases, and Company content are protected. Users may not copy, modify, distribute, sell, sublicense, scrape, reverse engineer, or exploit them except as expressly allowed.

A copyright complaint should identify the protected work, infringing material and location, complainant's contact information, good-faith belief, a statement under penalty of perjury regarding accuracy and authority, and a signature. NTE may remove content and restrict repeat infringers. Knowingly false notices may create liability.

28. Moderation, Suspension, and Account Deletion

NTE may investigate and take proportionate action, including warnings; visibility, messaging, sales, booking, purchase, or payout limits; content removal; transaction cancellation; suspension; or termination. Grounds include violations, safety, fraud, infringement, legal requirements, security, or material Platform risk.

Where appropriate, NTE may provide notice and an appeal opportunity. Immediate action may be taken to protect a person, evidence, funds, systems, or compliance.

Users may request account deletion through available functionality or the contact information below. Deletion does not erase payment obligations, disputes, transaction records, content shared by others, or lawfully retained records. App-store subscriptions generally must be canceled through that store.

29. Third-Party Services and App Stores

The Platform may rely on processors, app stores, conferencing tools, hosting, social networks, AI providers, analytics, maps, and communications systems. Their separate terms and policies may apply, and NTE is not responsible for matters beyond its reasonable control.

Apple, Google, or another marketplace is not responsible for NTE support, warranties, or services. Purchases, subscriptions, refunds, and cancellations processed by a marketplace may follow that marketplace's rules. Apple and its subsidiaries are intended third-party beneficiaries where Apple's applicable terms require it.

30. Availability and Platform Changes

NTE may add, test, modify, limit, pause, or discontinue features for security, legal, operational, technical, or business reasons and does not guarantee uninterrupted service. Roadmaps, estimated dates, beta features, and development announcements are goals, not guarantees unless expressly promised in writing.

NTE will not materially reduce a prepaid service during its term without a reasonable substitute, credit, refund, or remedy where required by law.

31. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." NTE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT EXCEPT WHERE THEY CANNOT LEGALLY BE DISCLAIMED.

NTE DOES NOT WARRANT THAT THE PLATFORM, PROVIDERS, USER CONTENT, LINKS, AI OUTPUTS, OR THIRD-PARTY SERVICES WILL ALWAYS BE ACCURATE, AVAILABLE, SECURE, ERROR-FREE, OR SUITABLE. THIS DOES NOT LIMIT EXPRESS WRITTEN PROMISES OR NONWAIVABLE CONSUMER RIGHTS.

32. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NTE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, OPPORTUNITIES, DATA, OR REPUTATION ARISING FROM THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NTE'S TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT THE CLAIMANT PAID TO NTE FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE PRECEDING TWELVE MONTHS OR (B) US $100.

These limits do not cover liability that cannot lawfully be limited, including where applicable fraud, willful misconduct, gross negligence, or legally nonwaivable personal-injury liability. Some jurisdictions do not permit certain exclusions.

33. Assumption of Risk and Indemnification

Users voluntarily assume ordinary and inherent risks associated with services and interactions they choose, including physical activity, travel, in-person meetings, online communications, and independent Providers. This does not waive nonwaivable claims or excuse express written obligations.

To the extent permitted by law, you agree to indemnify NTE and its owners, officers, employees, contractors, and affiliates from third-party claims and reasonable costs arising from your unlawful conduct, material breach, infringement, submitted content, or offerings you sell. NTE will provide reasonable notice and allow reasonable participation in the defense. Consumers do not indemnify NTE for NTE's own unlawful conduct.

34. Informal Resolution, Arbitration, and Class Waiver

Before filing a formal claim, the parties will attempt good-faith resolution. A notice must identify the claimant and account, relevant facts, requested relief, and contact information. Send it below with the subject Legal Dispute Notice. Either party may proceed after thirty (30) days if unresolved. This does not prevent urgent injunctive relief, agency reports, or eligible small-claims actions.

Except for eligible small claims, urgent injunctive relief, intellectual-property misuse, or nonarbitrable claims, disputes will be resolved by binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under applicable Consumer Arbitration Rules. Arbitration may occur remotely, by documents, or in a reasonably convenient place. NTE will pay fees required by applicable consumer rules, and the arbitrator may grant any individual court remedy.

Claims must be individual, not class, collective, consolidated, mass, private-attorney-general, or representative actions, where permitted. If this waiver is unenforceable for a claim, that claim proceeds in court, not class arbitration.

You may opt out of arbitration within thirty (30) days after first accepting these Terms by emailing your name, account email, and clear opt-out request to NTE.

35. Governing Law

Georgia law and applicable federal law govern these Terms, without regard to conflicts principles. Nonarbitrated disputes may be brought in courts with jurisdiction over Lawrenceville, Georgia, except where mandatory consumer law allows or requires another forum. Nothing deprives consumers of mandatory protections of their residence.

36. International Use and Sanctions

International Users are responsible for applicable local laws, licenses, taxes, import and export restrictions, and professional rules. NTE may restrict service for legal, safety, sanctions, payment, or operational reasons.

The Platform may not be used in violation of sanctions, export controls, anti-money-laundering, anti-terrorism, or trade laws. NTE may block transactions or accounts and make legally required reports.

37. Force Majeure

NTE is not liable for delay or failure caused by events beyond reasonable control, including disaster, war, unrest, public-health emergencies, government action, sanctions, utility or internet failure, cyberattack, transportation disruption, labor disputes, supplier failure, or widespread outages. NTE may reasonably suspend, reschedule, modify, or cancel affected services and will address prepaid undelivered services as required by law and applicable policy.

38. Electronic Communications

You consent to receive agreements, disclosures, receipts, booking details, account notices, security alerts, and legal notices electronically. Marketing may be declined using unsubscribe controls. Opting out of marketing does not stop transactional, security, or legal messages. Keep contact information current.

39. Changes to These Terms

NTE may revise these Terms prospectively. The updated date will be posted, and material notice will be provided where required. Changes do not retroactively alter completed transactions or accrued rights unless lawfully agreed. Continued use after the effective date constitutes acceptance where permitted. Material arbitration changes do not apply to a dispute for which the parties already had actual notice.

40. Termination, Assignment, and Severability

You may stop using the Platform or request account deletion. Termination does not cancel third-party subscriptions or eliminate outstanding balances, refunds, disputes, transaction records, prior licenses, or provisions that must logically survive.

You may not transfer these Terms or an account without NTE consent. NTE may assign them during a merger, acquisition, reorganization, financing, asset sale, or Platform transfer, subject to law.

If a provision is unenforceable, it will be limited or severed to the minimum necessary, and the rest continues. Failure to enforce is not a waiver. Payment, intellectual-property, content-license, dispute, disclaimer, liability, indemnity, and logically surviving provisions remain effective after termination.

41. Entire Agreement and Priority

These Terms, the Privacy Policy, Community Guidelines, and applicable transaction terms form the agreement. Transaction-specific terms control that transaction, followed by these Terms and Community Guidelines; the Privacy Policy controls descriptions of personal-information practices.

These Terms supersede prior general Student & Client Terms covering the same subject. A specific waiver or amendment must be in an authorized writing.

43. Acknowledgment

By accessing, registering for, purchasing through, booking through, selling through, posting to, communicating through, or otherwise using the Platform, you acknowledge that you have read and agree to these Terms. This information is collected to facilitate educational services, improve learning experiences, support tutors and students, and enhance Platform functionality.

Account Information

The Company may collect information associated with User accounts including usernames, passwords, login credentials, account settings, profile details, account preferences, subscription information, purchase history, booking history, support interactions, and related account activity.

Users are responsible for maintaining the confidentiality of account credentials.

Payment Information

When Users purchase services, subscriptions, products, memberships, or other offerings, payment-related information may be collected.

Payments are generally processed by third-party payment processors. While the Company may receive transaction-related information, we generally do not intentionally store complete payment card numbers, banking credentials, or sensitive payment authentication information unless necessary for operational purposes.

Payment processors maintain their own privacy and security policies.

Marketplace, Seller, and Payout Information

Users who are permitted to sell, license, publish, or offer products or services through the Platform may provide additional information such as legal name, business name, tax information, taxpayer identification information where required, payout account information, identity-verification records, transaction history, product and service listings, pricing, refund activity, chargeback information, and information required by payment, tax, fraud-prevention, or regulatory providers.

Unless a separate written agreement or clearly displayed program term states otherwise, an eligible seller receives 60% of the applicable completed sale amount and NTE retains 40%. The applicable completed sale amount, deductions, payout timing, refunds, chargebacks, taxes, currency conversion, payment-processing costs, app-store charges, and other transaction terms are governed by the Terms of Service and any seller-specific terms presented at registration, listing, checkout, or payout. This section discloses how related transaction information may be processed; it does not replace those contractual terms.

We may use and share seller and transaction information to process payments and payouts, calculate platform allocations, issue tax documentation, administer refunds and chargebacks, investigate fraud, enforce Platform rules, respond to disputes, satisfy legal obligations, and maintain financial and audit records. Payment processors, app stores, banks, tax-service providers, and other authorized vendors may independently collect or process information under their own policies.

Booking and Scheduling Information

The Company may collect booking information including lesson selections, scheduling preferences, availability information, booking history, attendance records, cancellation information, communication records, travel-related information, venue information, and related scheduling data.

This information is used to facilitate service delivery and improve operational efficiency.

Donations and Supporter Information

When Users make a donation or provide financial support through the Platform, we may collect the donor's name, contact information, amount, date, designation, message, transaction identifier, receipt information, and communication preferences. Payment credentials are generally processed by a third-party payment provider. Unless expressly stated otherwise at the time of payment, support provided through a donation feature is voluntary, is not an investment or purchase of ownership in NTE, and may be nonrefundable to the extent permitted by law.

Information voluntarily submitted may be visible to other Users depending upon Platform settings and service functionality. Users should not post sensitive personal information, confidential records, private student information, financial credentials, government identification numbers, health information, or another person's personal information without lawful authority.

Community Social Page and Community Service Pages

The Platform may allow Users to create profiles, follow topics or other Users, publish posts, comment, react, communicate, advertise or describe services, receive inquiries, make bookings, upload media, report content, and interact with community members, businesses, tutors, educators, and service providers. We may collect and process the content of those interactions; profile, follower, engagement, and moderation information; service categories and locations; booking or inquiry details; reports and appeals; and records of actions taken to enforce Platform rules.

Content or profile information designated as public may be indexed by search engines and viewed, copied, shared, archived, or redistributed by others. Deleting an account or post may not remove copies previously shared, indexed, cached, quoted, or lawfully retained. NTE may use automated tools and human review to detect spam, scams, harassment, exploitation, unsafe conduct, prohibited services, intellectual-property violations, or other rule violations.

Community service providers and sellers are generally independent Users rather than employees or agents of NTE. Information a User sends directly to a provider may be handled by that provider. Users should review the provider's disclosures and exercise care before sharing personal information or arranging an off-Platform or face-to-face interaction.

Blogs, Articles, Newsletters, and Editorial Content

When Users read, subscribe to, comment on, submit, share, support, or otherwise interact with NTE blogs, articles, newsletters, or editorial content, we may collect subscription information, reading and engagement activity, comments, author or contributor information, content submissions, support or donation information, and related communications.

NTE articles may discuss public events, legal proceedings, allegations, employment matters, educational policy, and other newsworthy subjects. We may process publicly available information, records supplied by sources, correction requests, and communications from people or organizations discussed in an article for editorial, accuracy, legal, safety, and recordkeeping purposes. Publishing an allegation does not mean NTE has independently determined that it is true. Blog and editorial content is provided for educational and informational purposes and does not constitute legal, medical, financial, or other professional advice.

Technical Information We Collect

The Company may automatically collect certain technical information when Users access or interact with the Platform. Such information may include Internet Protocol (IP) addresses, browser type, browser version, operating system, device type, device identifiers, language settings, time zone settings, screen resolution, internet service provider information, application usage information, referral sources, and other technical information necessary for security, analytics, troubleshooting, and operational purposes.

The Company may also collect information regarding how Users navigate and interact with the Platform, including pages viewed, features utilized, links clicked, session duration, search activity, error reports, login history, and usage patterns.

Mobile Application Information and Device Permissions

When a User accesses the Platform through a mobile application, we may collect application version, device and advertising identifiers, operating-system information, crash and diagnostic data, notification tokens, installation and update information, and interactions with application features.

Certain features may request access to a device's camera, microphone, photographs or media library, files, notifications, calendar, contacts, or approximate or precise location. We will request permission through the device or application where required. Access is used only for the feature described at the time of the request or another disclosed purpose. Users may change permissions through device settings, although disabling a permission may prevent the related feature from functioning.

NTE does not continuously collect precise geolocation information unless a feature requires it and the User has granted permission. We do not access contacts merely because the application is installed. If a User chooses a feature that invites, shares with, or schedules another person, only the information reasonably necessary to perform that request should be processed.

Push Notifications

With permission, the Platform may send push notifications concerning messages, bookings, account activity, saved content, followed topics, service updates, security, promotions, or other Platform activity. Users may manage push-notification permissions through device or application settings. Transactional or security notices may still be delivered through another available channel.

Users acknowledge that AI-generated responses may not always be accurate, complete, current, or suitable for specific circumstances.

Users may opt out of marketing communications through available unsubscribe mechanisms or by contacting the Company directly.

Certain operational, legal, account-related, security-related, or transactional communications may continue to be sent even if a User opts out of marketing messages.

Service Improvement and Research

Information may be analyzed, aggregated, anonymized, pseudonymized, or otherwise processed to improve services, develop new products, identify trends, improve educational experiences, evaluate business performance, conduct research, and support innovation initiatives.

Where possible, aggregated or anonymized information may be used in a manner that does not directly identify individual Users.

The Company may use collected information to detect, prevent, investigate, monitor, and address fraud, abuse, unauthorized access, suspicious activity, policy violations, cybersecurity threats, payment issues, account misuse, identity verification concerns, and other security-related matters.

Information may be reviewed manually or through automated systems to protect Users, Platform assets, and business operations.

The Company may share information with authorized parties where reasonably necessary to operate the Platform, provide services, fulfill legal obligations, maintain security, improve user experiences, or support business operations.

Information may be stored on servers, cloud environments, backup systems, databases, archives, and technology infrastructure operated by the Company or authorized third-party providers.

User Security Responsibilities

Users play an important role in maintaining security. Users are responsible for maintaining strong passwords, protecting account credentials, safeguarding devices, monitoring account activity, updating software, securing internet connections, and taking reasonable precautions to prevent unauthorized access.

The Company shall not be responsible for losses resulting from a User's failure to maintain adequate security practices.

Security Incident Response

The Company may investigate, respond to, mitigate, contain, monitor, report, and remediate actual or suspected security incidents, unauthorized access events, cybersecurity threats, fraud attempts, data breaches, system compromises, and other security-related matters.

Information may be utilized as reasonably necessary to investigate and address such incidents.

The Company reserves the right to take appropriate actions to protect Users, systems, data, and business operations.

Children's Privacy

New To Education provides educational services that may be utilized by minors under the supervision or authorization of a parent, guardian, school, educational institution, or other authorized adult where permitted by applicable law.

Children under 13 may not independently create an account or submit personal information unless NTE has implemented an age-appropriate experience and obtained verifiable parental consent where required by the Children's Online Privacy Protection Act or other applicable law. Parents and guardians remain responsible for authorizing and supervising a minor's use of the Platform.

Where required by law, parental consent may be requested before collecting certain information from minors.

Parents or guardians who believe that personal information relating to a child has been collected improperly may contact the Company to request review, correction, deletion, or other action as permitted by law.

NTE does not knowingly use children's personal information for targeted advertising, sell children's personal information, or permit a child to make personal information publicly available without the authorization required by law. We may limit, disable, or remove a minor's account or content when necessary to protect the child, comply with law, or enforce Platform rules.

User Privacy Rights

Depending on the jurisdiction in which a User resides, Users may possess certain privacy rights regarding personal information.

Such rights may include the right to access personal information, request correction of inaccurate information, request deletion of information, request restriction of processing, request portability of information, object to certain processing activities, withdraw consent where consent serves as the legal basis for processing, and submit complaints to applicable privacy regulators.

The Company will consider and respond to requests in accordance with applicable laws and operational requirements.

The Company reserves the right to verify identity prior to processing requests.

Right to Access Information

Users may request information regarding the categories of personal information collected, the sources from which information is obtained, the purposes for which information is used, the categories of third parties receiving information, and other information required by applicable law.

The Company may require reasonable verification prior to fulfilling requests.

Right to Correct Information

Account Deletion

Users may request deletion of an NTE account through any account-deletion function made available in the Platform or by contacting NTE at the email address listed below. A request should identify the account and may require identity verification. When a qualifying request is completed, the account will be deleted or deactivated and personal information will be deleted, deidentified, or retained only as permitted or required for transactions, taxes, fraud prevention, safety, disputes, legal compliance, intellectual-property protection, backups, and other lawful purposes.

Deleting an account does not automatically cancel an active subscription, resolve an unpaid balance, reverse a completed transaction, remove content copied or shared by other Users, or eliminate records NTE must lawfully retain. Users should cancel applicable subscriptions through the original billing provider, including an app store when applicable.

Privacy Requests, Appeals, and Authorized Agents
